I would actually recommend that you have all of these documents prepared, no matter the current or future impacts of the Obergefell v. Hodges cases being attacked.
This statement is for all married couple, no matter their gender or non-gender determination.
- Last Will and Testament;
- Revocable Living Trust;
- Person in charge of the Disposition of your remains;
- Living Will (Advance Directive);
- Healthcare Power of Attorney (Medical Proxy);
- Hospital Visitation Authorization;
- Durable Power of Attorney:
- Pet Directive; and
- Tangible Personal Property Memorandum.
In addition, if are married and are already co-mingling your money, make sure your spouse is designated for item to do to them at the time of your death (if not in Revocable Living Trust).
Make sure you contact a lawyer in your State, whom is knowledgeable about these matters, and it will make your life (and your spouse’s) less stressful.
